


Circuit Judge David Audlin has again recused himself from hearing a case related to the ongoing theft and fraud investigation in the Monroe County school district, this time declining to preside over the arraignment and further proceedings of Superintendent Randy Acevedo.
Monday's recusal in effect canceled the suspended superintendent's arraignment, which had been scheduled for 8:45 a.m. today.
"The case was removed and sent to Chief Judge Luis Garcia to be reassigned," Assistant State Attorney Mark Wilson said Monday. "He will reset arraignment, which we believe should be at least June 30."
During arraignment, defendants name their attorneys and enter a plea. Prosecutors and the defendant's lawyer also can request preliminary court dates and notify the court of any unique circumstances in scheduling they'd like the judge to consider.
Acevedo, who was suspended without pay after his arrest Thursday, is charged with obstruction of justice, a third-degree felony.
Prosecutors say he knowingly provided a falsified letter that justified an XM satellite radio subscription his wife allegedly purchased with district funds -- ostensibly for the MARC House nonprofit organization. It later was revealed the subscription was purchased in the name of Acevedo's son, Wade.
Audlin earlier this month recused himself from presiding over the case of Acevedo's wife, former Adult Education Coordinator Monique Acevedo. She is charged with stealing more than $180,000 in cash from cosmetology student and salon services fees.

They're both flight risks now. No jobs. Home in foreclosure. Belongings will be seized to repay the [alleged] theft (thought it won't come close to doing so.) Their son seems to be in possession of stolen goods. The whole family [allegedly] is involved in tax evasion and tax fraud. I mean, in what world are the Acevedos NOT a flight risk????
They'll go the way of Bum Farto and we can thank Audlin for it. As noted in these comments, remember this come election time. Remember everyone who is involved with the Acevedos, including any Henriquez, McPherson, DiGennaro, Estenoz, and many, many more.

If Judge Audlin felt the need to recuse himself after releasing Monique without bail, why did he not feel compelled to recuse himself a second time until after he released her husband, Randy, without bail?
Audlin felt too conflicted conflicted to handle Monique's case (releasing her without bail after she fled the jurisdiction and missed a appearence) and then suddenly didn't feel too conflicted to release her husband Randy without bail, before getting a case of the recusal blues again?
Do I have that correctly bubba?

Letting Randy and Monique BOTH out without bail in light of the alledged theft of at least half a million dollars of school funds is a travesty of justice
