Judge Audlin recused from Acevedo case

Circuit Judge David Audlin has again recused himself from hearing a case related to the ongoing theft and fraud investigation in the Monroe County school district, this time declining to preside over the arraignment and further proceedings of Superintendent Randy Acevedo.

Monday's recusal in effect canceled the suspended superintendent's arraignment, which had been scheduled for 8:45 a.m. today.

"The case was removed and sent to Chief Judge Luis Garcia to be reassigned," Assistant State Attorney Mark Wilson said Monday. "He will reset arraignment, which we believe should be at least June 30."

During arraignment, defendants name their attorneys and enter a plea. Prosecutors and the defendant's lawyer also can request preliminary court dates and notify the court of any unique circumstances in scheduling they'd like the judge to consider.

Acevedo, who was suspended without pay after his arrest Thursday, is charged with obstruction of justice, a third-degree felony.

Prosecutors say he knowingly provided a falsified letter that justified an XM satellite radio subscription his wife allegedly purchased with district funds -- ostensibly for the MARC House nonprofit organization. It later was revealed the subscription was purchased in the name of Acevedo's son, Wade.

Audlin earlier this month recused himself from presiding over the case of Acevedo's wife, former Adult Education Coordinator Monique Acevedo. She is charged with stealing more than $180,000 in cash from cosmetology student and salon services fees.

Everyone who wrote below this should at least attempt to learn just a little bit about the justice system and the bill of rights. It really makes them sound ignorant when they make comments like that.

Change of venue needed

There is no way they will get a fair trial in Monroe County. Sounds like they need to move it elsewhere and probably will.

The need to be trial here, the steal the money here.

The commit the crime here, the sure be trial here and give some example to every one else. I am extremelly disapoint it at Judge Audlin( He was my favorite ) Until he screw up big time. I will not vote for him...What kind of Bologni? No bail? Judge is not fair! Everyone sure be treated the same...

Come on, Bubba! It doesn't take a rocket scientist to figure it

out. Audlin shouldn't have been involved in the bail hearings for EITHER of these. He KNEW he was connected to them before the very first hearing!!! If he recused himself from further dealings with Monique, he knew BEFORE THEN that he shouldn't be handling the case. He shouldn't have been involved and I think that the bail hearings need to be revisited.

They're both flight risks now. No jobs. Home in foreclosure. Belongings will be seized to repay the [alleged] theft (thought it won't come close to doing so.) Their son seems to be in possession of stolen goods. The whole family [allegedly] is involved in tax evasion and tax fraud. I mean, in what world are the Acevedos NOT a flight risk????

They'll go the way of Bum Farto and we can thank Audlin for it. As noted in these comments, remember this come election time. Remember everyone who is involved with the Acevedos, including any Henriquez, McPherson, DiGennaro, Estenoz, and many, many more.

The Acevito's have been treated as an exception

If Judge Audlin felt the need to recuse himself after releasing Monique without bail, why did he not feel compelled to recuse himself a second time until after he released her husband, Randy, without bail?

Audlin felt too conflicted conflicted to handle Monique's case (releasing her without bail after she fled the jurisdiction and missed a appearence) and then suddenly didn't feel too conflicted to release her husband Randy without bail, before getting a case of the recusal blues again?

This is the bubba system rubbed in the face of the entire county by a sitting judge and former assistant city attorney

As you wished, I guess we all just learned 'a little bit about the justice system' down here ... but I certainly don't think the Bill of Rights came into play

Poor Randy and Monique

need a change of venue to get a fair trial? Maybe the public should demand a visiting judge to deal with pre-trial issues. The public needs the laws enforced without favoritism or the bubba system playing a roll. Remove Audlin from the bench next election. Send a strong message. Time to turn this town on its ear and weed out the corruption and favoritism that runs rampant.

Audlin a former assistant city attorney is the go to guy for the city when they want an advantage in "home" Court

Letting Randy and Monique BOTH out without bail in light of the alledged theft of at least half a million dollars of school funds is a travesty of justice

Audlin exemplifies the worst of how the bubba system erodes trust and treasure of our community

Remember his favors to the Acevetos when he next stands for election

Audlin was never voted in as a circut judge

he simply became one by 'default' when Richard Payne retired at the 11th hour and 59th minute David Audlin ran for the vacancy and with 'no opposition' candidate 'poof' like majic became judge by default without an election vote! isn't the 16th circuit fun? or should this be a barf alert?

That's how we got DiGennaro

The fix was in. No opposition. Come on, Marathon! Let's get a good, honest candidate in there.

The City Always Wins with this Guy

When our swarmy City Attorney goes judge shopping Audlin, is always on the top of the list

You don't want to bring an action against the city before this guy's Court

Speaking of shopping and Judge Audlin, I wonder if his honor honors the MCSB P-Card?

How could you let them both out without bail after all that has been exposed?

How can any judge set bail on anyone if they let this duo out without bail?

Why didn't Audlin step down immediately? Why did he wait til the last minute (Acevedo's arraingment today) to recuse himself? Another closed door decision. I wonder if Godbubba Bookie was there?

All the people in the Monroe County jail charged---------

with lesser crimes can now point to this couple and say "I want the same treatment they get"..........whats the legal term for this?
