Former jailer sentenced for drug trafficking

A former Monroe County Sheriff's Office corrections officer who agreed to smuggle drugs into the Florida Keys was sentenced to more than 16 years in prison Wednesday.

Shawn Michael Hernandez, 33, pleaded guilty on Aug. 17 to charges of possession with intent to distribute narcotics, conspiracy to traffic narcotics and possession of a firearm in commission of a felony.

A federal judge sentenced him to 16 years and 3 months in prison and five years of supervised release, according to U.S. Department of Justice spokeswoman Annette Castillo.

Hernandez and his co-defendant, former Florida Fish and Wildlife Conservation Commission officer Jonathan Scott Jacox, 33, were snared in a 2 1/2-month Florida Department of Law Enforcement and FBI investigation that began on Feb. 2 when Hernandez contacted an undercover agent in Homestead about transporting drugs to the Florida Keys.

Hernandez picked up a kilogram of cocaine and took it to an undercover agent on Stock Island in exchange for $1,500 and made another pickup on March 12 for shipment to Key West. On the March 12 trip, 4 kilograms of fake "cocaine" and 1 kilogram of fake "heroin" were used.

Hernandez was paid $5,000, of which Jacox was to receive a cut for working as "armed counter-surveillance" during that trip.

Both men were arrested on April 17 after making a third run of fake drugs to Key West for an additional $5,000.

State and federal agents taped conversations with both men, neither of whom was on duty when the crimes took place, but were fired after their arrests, according to Monroe County Sheriff Bob Peryam and wildlife commission spokeswoman Carol Pratt.

Jacox in September was sentenced to 7 1/2 years in prison, including five years of supervised release after prison on charges of conspiracy to possess with intent to distribute cocaine and heroin; conspiracy to posses a firearm in furtherance of a drug-trafficking crime; and possession of a firearm in the furtherance of a drug-trafficking crime. He pleaded guilty to those charges on June 5.

cocaine is harmless

the abuse of cocaine is the concern, not cocaine in of itself. 99.9% of people that do cocaine do not have an addiction problem and they dont go out and commit other crimes. dont beleive all the anti drug war propaganda. you people always confuse drug addicts with people that are responsable recreational drug users. not all people that drink beer are alcoholics are they? no. so how can you say people that do other drugs are evil and turn into real crimminals and become addicts? doing a line of cocaine or drinking a beer is in of itself a victimless crime. did you just hear about the priest that got sentenced to 16 years in prison for maryjuana? what a witch burnnind and an american tragedy. end the drug war or make alcohol illegal again. you cant have it both ways you hypocrites. jf

Drivel

This, and jf's other comments have got to be the biggest line of B.S. I have ever read on here. jf, you are a real piece of work. It's people who think like you that really make me worry about the state of this nation and world.

Agreed.

Total garbage. I'd like to know what scientific study he got that 99.9% statistic from. The truth is, cocaine has been shown in scientific studies to raise your heart rate, constrict blood vessels, and dangerously raise your blood pressure. This increases risk of heart attack in even healthy people, much less those with an unknown preexisting condition. That alone makes use of cocaine dangerous and irresponsible.

i cant beleive how ignorant smart people can be!~

the statistic is from the 100 people i know that do cocaine. 1 out of 100 had a problem. the rest never missed a single day of work or robbed a store.// jogging raises your heart rate too. but what is the crime or problem with doing cocaine and having your heart rate go up,ect? really, so what? sky diving does the same thing to a person, (and that is a good analogy). cocaine is harmless unless abused or miss-used yes. if we follow your logic then we should all make illegal; jogging, bungie jumping,sex,ect.ect. jf

witch burning

just because you think i am wrong does not mean i am not right. if people like you want to put other people in prisons just for partying, we all better worry about the state of the nation! jf

Wrong

Oh no, there is no doubt. You are definitely wrong.

assuming jf is wrong

then lets make alcohol illegal again.what do you say?

Wake Up People

Who the hell are you people standing up for these scumbags? You people falling back on this supposed "drug war" in order to minimize these men's crimes are simply pathetic. Do you really believe that cocaine is harmless? Are you that freakn' stupid? These were two cops who smuggled dope into the keys. One used his official position to act as armed security for the transport. These men are scum and I don't care what you people say about them. If life has gotten that hard down here for them, they should have moved, not resorted to drug smuggling.

cocaine is harmless

fact. you can actually die if you drank too much water! the point is cocaine is harmless. it is the abuse of cocaine that can harm you. any thing can kill you in excess. stupid.

let him go

dont put him in prison for a victimless crime. use our resorces to go after real crimminals that really do hurt other people. end the stupid drug war. jf

VictimlessCrime? What?

Cocaine is a victimless crime? You need to wake up from your little drug induced dream world.

beer is a victimless crime

dont confuse drug addiction with responsable recreational drug use. possession of cocaine is a victimless crime jf

What a joke

victimless crime? Having come from a family that had drug abuse there are always victims. Dont do the crime if u cant do the time

dont confuse drug abuse with drug use

dont punish the rest of us because your family had a drug addiction. if someone in your family was an alcoholic would you like to see alcohol made illegal again for everybody? can you imagine people going to prison for drinking a beer? (thats what happened in the 1930's during prohibition!) we dont put our alcoholics in prison today . why should we put people in prison for doing other drugs? end the stupid medevil drug war or make alcohol illegal again! drug possession and responsable recreational drug use is a victimless crime. jf

Well Deserved

These two got exactly what they deserved for breaching our public trust. Now, what would it take to get our local drug dealers who get arrested over and over again a sentence like this? The sentence is well deserved, but seems a little unfair compared to the numerous slaps on the wrist given to the career criminals on our streets.

Only half right...

You're right about the sentence being unfair... we hear about child molesters and career criminals racking up literally two or three dozen convictions, still on our streets and destroying our society. Get the facts straight: There was no criminal conspiracy, there were no drugs, there was only a massive federal and state task force entrapping two stupid and desperate dupes (both slaving away in the ridiculously overpriced Keys economy -- one planning a wedding and desperately waiting to move out of the keys to a different job so that he can afford to take care of his wife, and another who had to move back to his old job in the keys because the jobs were so scarce when he tried to leave). You dangle bait long enough in front of people and sooner or later someone bites. The joke's on us, though. While these federal agencies spent three months, three agencies, thousands of man-hours in investigation and surveillance, hundreds of hours of phone-taps and recordings (mostly of these two really great guys shooting the breeze on the phone), real criminals were out there perpetrating real crimes and being ignored, raping, murdering and harming real people, like you and me. And by "real criminals," I mean those who commit crimes on their own, without the FBI searching them out and paying them thousands of dollars to do it, just so that they can pretend to play cops and robbers. These guys are you and me, with just a couple fewer IQ points. Is anyone so very squeaky clean that they could never be caught at a bad time and steam-rolled by the "justice" system? These cops are pansies who don't have the cojones to pursue real, dangerous criminals. So they spend their days entrapping suburban housewives and otherwise law-abiding minimum wage earners to pretend to commit crimes, complete with fake cartels and fake drugs. Fake criminals are so much easier, because they don't know how to properly execute a conspiracy, silence a witness, keep from being recorded by surveillance, and kill cops. I see the appeal, from an FBI agent's point of view. If I was lazy and self-interested, and just wanted to trade a few hours of busy-work for a paycheck, I'd probably do the same. But I'm not. I'd go after real criminals, and make a difference. Like I said, the joke's on you and the joke's on me. We taxpayers now have to pay twenty million dollars for this investigation and prosecution, and more millions on the prison maintenance for these two guys (for a total of perhaps 25 years), who were trying to live their lives before they were targeted for this sting. Thanks FBI and FDLE! You're the reason I have to stock up on so many guns -- because when I'm the victim of a crime, you won't be there. I'll be all by my lonesome with a dangerous criminal. Why? Because you're off padding your resumes with useless legal games, using parlor tricks, smoke and mirrors to paint average citizens as drug cartels, while conveniently ignoring any work that smacks of effort. Congratulations. Do something useful, so that I can sleep soundly at night -- go find somebody committing a crime NOW and stop them. Find somebody who committed a crime YESTERDAY and catch them. Don't waste all of our time and money convincing people to commit crimes TOMORROW and then sit around the surveillance cameras, bukkake-style, watching them do it. To good cops, fighting the good fight in the trenches every day: Thank you! Thanks for not wasting all of our time and money pretending to fight crime.

Only half right

Thats the truth, Thank you.

Dopes

Having grown up with these so called dupes, let me tell u this isnt there first run in with drugs. And to say the economy was there reason for dealing drugs is ridiculous. They made the choice so they have to deal with the punishment.

you seem to know them

Well if you seem to know this isn't their first run in with drugs, then I must wonder how do you know that info..... Did you do drugs with them??? And I guess you must also know of other times they transported drugs like this too!!! Since you have so much info maybe the FBI should be looking at you???? Beware

Thank you!!!!

As a family member of one of these men and a very good friend of the other I would like to say thank you for posting this comment. You really couldn't have said it any better! It has been the biggest nightmare that anyone could ever imagine as a family member. These men did not go looking for this nor had they ever done anything like this before. Our local, state, and federal government set this whole thing up, and then they want a pat on the back for taking 2 drug dealers off the streets.... PLEASE, these 2 guys were the furthest from criminals! I want everyone to know that if it can happen to them it can happen to you too. You have NO idea what you will actually do unless you yourself are put into a setup like they were. I love them both, and will support them 100% until the day they are back hme with us again. Thanks again for your great post!!!!!

Oh stop!

Sorry your relative and friend is in jail. But guess what? Had they gotten away with it then they would have been full-fledged drug dealers instead of just the wannabe dealers they are. They would have kept doing it and doing it until they got caught or killed. You should be thanking the Feds for stopping them on their new career move before they got started.

honorable profession

providing a service in demand is an honorable proffession.

Don't be sorry

THEY WERE SET UP!!!! What part of that doesn't anyone understand????????? And get your facts straight too, they weren't "DEALING" they were "TRANSPORTING" big difference, read the charges if you know so much about the crime!!! Thankful to the Feds, not a chance in hell!! Why don't you as a US taxpayer be thankful that now you get to put nice clean clothes on their bodies, oh yeah and nike Tennis shoes, feed them 3 times a day, medical treatment, and thank you becuase now our family can recieve financial assistance from the government too!!!! I'm really thankful believe me!!!!

What is your definition of a

What is your definition of a criminal? Sounds like they are criminals to me.

you me we are all crimminals!

driving 1 mile over the speed limit is a crime. the issue here is crime vs. punishment. drug possession is a victimless crime. solution: legalize all drugs and there will be no crime involving drugs! you rob a store you go to jail for robbing the store, not because you had drugs on you.

Wrong Again

Once again, you are wrong. Driving over the speed limit is a traffic INFRACTION, not a crime. A crime is anything classified as a misdemeanor or felony, and has a set maximum jail sentence. Traffic tickets carry monetary, civil penalties. YOU are a criminal, not me.

infractions are crimes.

possession of cocaine ( and some other drugs) is the only victimless felony on the law books. possesion, if it is to remain illegal, should be an infraction, not a felony. the issue here is crime vs. punishment. i think it is backwards. driving over the speed limit should be a felony! during prohibition in the 1930's it was a felony to drink a beer! do you want to see that come back? the true fact is that no one in recorded history has ever been harmed in any way shape or form by possessing cocaine. now the statistics of harm to others caused by driving over the speed limit...... you do the math jf

Oh....

Nevermind. You are incapable of listening to reason or fact. Good luck with your misguided life.

your right

nevermind. facts are stupid things . good luck with your natzi resoning. jf

yes i am

i have not heard a single explanation fom any of you anti drug people on why we should put people in prison for simply possessing a small amount of drugs,( a victimless crime). i am open minded. explain your reasoning to me jf

Yeah. It's the fed's fault.

What freakin' planet are you from?! Who knows what these two "great guys" could have gotten into without the feds catching them? To the FBI, FDLE and all the other agencies out there everyday on the line, keep your heads down and your powder dry! Idiots like this don't know what you do everyday.

what parallel universe are you from?

you think that people that are involved in drugs are people that would rob stores or commit real crimes?? you watch too much t.v.. the real crime here is that entrapment is legal in florida! jf

Put down the bong for a second.....

Yes, people involved with drugs ARE people that rob stores and commit crimes. That's what people do when they are addicted to crack and heroin and can't hold a job. You ever lived in an inner city plagued with addiction? Have you ever lived in a country corrupted by drug money? I didn't get my views from Court TV. This isn't pot we're talking about here, smoky!

pot

i know a guy that smoked some pot then robbed a store. how do you feel about pot now mr. man? jf

wrong bong put down dude

not all people that do crack are addicts. i am talking about the majority of people that do drugs in a responsable recreational mannor. jf

could not have said it better!!

right on man. this drug war is what is desroying lives, and our justice system, and family, and careers. what a waist of resorces and our tax dollars. an american tragedy. end the drug war and set this guy free! jf

what about me!

i am 37 years old i got in trouble at 18 for simple possesion of controlled substance it was 2 lines 0.25gr of coke i now have a felony cant get jobs or even a nice place to live because it is public records im punishrd every day of my life for the rest of my life!i served 1 year in a treament/prison i did my time but still i am judged by my peers and sentenced on a daily bases for my crime 2nd degree felony never been in any trouble before or after yet here i sit with out a good paying job or even a good livivg enviorment! iwas always told drugs destroy your life!well the only destruction ive seen is at the hands of the judical system tht gave me a 2nd degree felony for my first infraction of the law! i do not agree with the use of cocaine but it was less damaging to me than the felony i now posses! the drug war is wrong wrong wrong! i could be your kid wrong place wrong time!
