Performer spots spark Sunset Celebration rift

All is not as picturesque at Mallory Square's Sunset Celebration as the tie-dyed sky would lead some to believe.

The nightly gathering of performers, artists and food vendors has been marred recently by a disturbance among the sunset denizens, and likely will result in a lawsuit being filed by longtime tightrope walker and Mallory Square mainstay Will Soto, who has been performing at the venue for 33 years.

Soto said he was escorted off the pier by police three times at the beginning of the month after some of his fellow performers claimed he was not following the group's rules and thus was trespassing.

"The police were very sweet, and I told them I would leave voluntarily because I knew they shouldn't be involved in what was an internal, civil matter," Soto told The Citizen Friday. "We're going to have to end up in court over this."

Mark Riggs, a unicyclist who is the chairman of the Cultural Preservation Society board, which leases the pier from the city each night, said on Monday that Soto was removed from the pier because he was rude "and cursed out our pier manager."

Soto said his right to be the first performer to select a setup spot each night was grandfathered 15 years ago into the guidelines that govern the Cultural Preservation Society (CPS), the group that coordinates the Sunset Celebration.

Riggs emphasized that no one wants Soto to leave the sunset celebration, but tensions are high given the longevity of several other performers, who also want preferential treatment in the selection of performance locations.

Each night before sunset, the performers choose their locations based on a lottery system. But Soto's seniority has allowed him to choose his spot first each evening, and thus set up his tightrope show at the water's edge.

"It all boils down to a couple of performers trying to pick their spots ahead of me," said Soto, who called his attorney, Richard Klitenick, after his removal from the pier.

Klitenick immediately sent a letter to the board members and its two paid pier managers. He sent copies of the letter, along with an e-mail message, to City Manager Jim Scholl, City Attorney Shawn Smith and Police Chief Donie Lee.

In the e-mail message, Klitenick explained that the CPS, which leases Mallory Square from the city each night, did not follow its own rules when board members eliminated Soto's "grandfathered" status, "resulting in embarrassment and loss of income, as well as creating a very negative image of our city to the throngs of visitors attending the Sunset Celebration."

He asked the Police Department to treat the situation as a civil matter and compared it to a typical landlord-tenant dispute.

As a result, Soto said, Scholl visited Mallory Square on Nov. 13 and told the performers and pier managers to stop calling the police and to settle the matter with lawyers rather than law enforcement.

Soto has resumed work, but said there is tension among the performers and the CPS board, which is headed by Riggs.

"Some new guys who don't like Will have assumed control," Klitenick said Friday. "They've got some renegade people down there who are changing the rules without following their own rules."

According to the group's lease with the city, any rule changes must be approved by city officials, Klitenick said.

The CPS board's recent acts represent a violation of Florida corporate law, and the board members could be liable individually, Klitenick said.

In his formal letter to the board members and pier managers, Klitenick asked to inspect all records of the board for the past two years, and asked that Soto be reimbursed for his five days' of lost income.

"The board and pier managers' actions, if not immediately corrected, will be met with legal action for damages and attorney's fees," Klitenick wrote. "Given that there is likely no officers and directors insurance covering any of you for this malfeasance, especially given that the board chair is a convicted felon ... each and every one of you will bear the entirety of costs, attorneys fees and damages, for which we have been instructed to pursue against you aggressively."

Klitenick was referring to the 2006 arrest of Riggs, the board's chairman, on White Street on charges of possession of heroin with intent to distribute. He was arrested again in 2007 for violation of probation.

Also in 2006, Soto was convicted of marijuana possession.

Klitenick said the board now has exposed itself to liability.

Riggs on Monday said that the board cannot afford attorneys and lawsuits and have recently been acquiescing to Soto's demands, and allowing him to select his spot first.

"We never wanted him not to work," said Riggs, who also said he has been performing at Mallory Square for 13 years.

"Hopefully they'll see the light and stop the black eye that is marking the city's Sunset Celebration," Klitenick said. "Who is a bigger ambassador to the city of Key West than Will Soto? He is the face of sunset."

Klitenick had not received any response from the CPS board or pier managers as of Friday afternoon.

Anyone who wishes can see the sunset for free at White St pier or Higgs Beach. In the winter it sets out over the Atlantic so you'll miss nothing. My favorite spot is in the water at Higgs, immersed to my neck thus getting the grazing rays as well.

Which Way Now?

Although I am a new-be citizen of Key West, I have followed the trials and tribulations of Sunset Celebration since its inception. What started as an income source for creative performing artists has devolved into the mess that the rest of this country is in: Those who already "have" will do whatever it takes to keep the status quo, just like health care. This article missed two critical elements, which are the limit of space due to pier construction and the increase of vendors. The Mallory performers share precious space with artisans and food sellers who are using the rules and guidelines to tear apart what was once a charming and really exciting performance event. Artisans tables and food stands use cables and electrical wires for the lights, which also take up space. These vendors complain about the nightly fee ($10-15) they MUST pay while performers are only asked for a contribution. However, those who sell something are pretty much guaranteed of an income, whereas tourists raised on TV and video games aren't so quick to part with a buck for the performers. Performance artists spend money to develop and practice their craft as well as their set ups, costumes and props to give an act strong enough to hold an audience in a public arena. These folks don't just get up on a unicycle or perform gymnastic feats on hard pavement on a whim! They've studied and (more or less), mastered their craft and then hope they will not just be noticed but COMPENSATED for being entertaining. The audience watches and can walk away without turning over a penny, but the vendors don't give away anything for free. Unfortunately, tourists don't think about these investments and in these hard times are more willing to buy some "thing" they can hold onto. From the tourist's point of view, a memorable experience isn't enough when you have to spend a minimum of $20 a day (per person) just to eat in "Paradise." Not all performers want to be in front of the sunset. The pleasure of acoustic music has almost disappeared from Mallory because of the cacophony of "Look at me" screamie meemies who take up 90% of the space. That said, individuals do have to be conscious of their actions and how they effect others. Will Soto is much less rude and obnoxious than Don Rickles but shouldn't expect "his" space to be held for him, whether or not he shows up. The "grandfathered" performers are supposed to call in to let the pier manager know they'll be there. It's not just a courtesy but a necessity born out of the minimal space. It's so sad to see yet one more expression of creative arts get torn apart by selfishness. Mallory performers and artisans need a board of directors which represents for the EVENT, not the individual. As for Mark Riggs, isn't it better for him to be working as a performer rather than selling drugs?

Will Soto is still a foul, loud mouth jerk, who tries to extract money from passerbys, isn't that panhandling? I find him to be rude to kids, as well as adults. My family never watches his act, beacause of his mouth. Yes, we tell others to avoid his space.

Will Soto is hardly the "Face of Sunset" in Key West! There are a lot of talented people working at Mallory pier; Soto is "Rudest of the Sunset Performers".

greed & crooked politics...is anyone surprised?

Mallory Square has gone the way the rest of Key West and the Keys has - the combination of greed and crooked politics spoiling things. We used to love taking visitors to the Square for sunset celebration - what used to be a unique and fun event, but not any more. The nasty "pier manager" (who looked like a homeless guy in dirty clothes and mismatched flip-flops last time I was there), aggressive and rude demands for more money from the performers, and decreasing quality of performances has kept us away. Now that I read their "chairman" was arrested for intent to distribute heroin...yeah, I won't be back. I'm not supporting that kind of person.

How can a felon be a member of the board, much less chairman?

The rules are approved by the city. So tell me, how is it that a convicted felon, involving Heroin no less, and on felony probation can be on a city sanctioned board, much less be elected the chairman of it? How do we know that his decisions are not under the influence of drugs? How reliable is this guy when he gets his probation violated. Who are the clowns that allow this?

Mr. Soto was a rude human being. I can't believe all the hoopla about the guy. He yelled at boats idling and watching from the water, ridiculed captains and visitors, and hard sold solicitations for money after his performances. Please go back where ever you were retiring to Mr. Soto. Most of us could care less about you or your spot.

As far as I'm concerned, Will lost his spot at Vagabond Square (f/n/a Mallory Square) when he HIGH tailed it to Asheville. If his Asheville Celebration WENT UP IN SMOKE he'll just have to get back at the end of the line in Key West. Peace

Mr Soto was a rude human

I have known Will Soto for 11 years. I have never known him to be rude to anyone. As for boats watching from the water I only ask "how can they anchor in that fast moving channel, and why would they stop with all the boat traffic going in and out at sunset. Someone should yell at them for being stupid and dangerous. Will and all of the other acts do go hard for solitations but still it is voluntary to contribute. After 30 years he was going to retire and move to Asheville, North Carolina and help start a sunset type festival up there. It didn't work out and he came home. I do care about the old time preformers at sunset and haved talked to Will about the old days before the quasi requlatory mess took over the sunset festival. Maybe this just goes to show how some power hungry simple minds can over regulate something that should require no regulation. If Will was grandfathered in to his spot on the wall then let him have it unless some 33+ year preformer lays claim. I'm sure the bad economy has helped fester this mess but you can take this to the bank.....Will Soto is not a rude human being!

I agree with this poster

I performed once, many years ago, at Key West. I am also a rope walker and it happened to be at a time when Will was not there and I was graciously allowed to perform on "Will's Hill" as his pitch was known. I met Will and found him to be a pleasant, giving human being. He has performed there for 33 years! Who else has that kind of dedication to the art of street performing? Street performing is an open forum. You can do an angry show, a happy show, a hard ass show, a sweet show, and there is always a place for you on the street. To those who criticize the one show they saw, (which may be the only "street show" they have ever seen) learn something about street performing, and learn how to appreciate one of the truly original, "real" types of performing left in the world today. If it is perceived as unfair, "grandfathering" so be it. How many "grandfathers" are still walking a tightrope after 33 years? Keep on keepin' on. Where there's a Will, there's a way.

Boating skills...

It's very easy, if you know how, to stay under power and stationary. No anchor necessary. I do it often and the only idiot yelling was always Soto.

I know a girl who was sweet on the pier in the 1997 area

This girl was so sweet to her customers. She was always smiling and very helpful. It was a mother daughter team. I heard she was voted off and coul'nt return back why. She made the beautiful jewelry and it was very affordable for all of us. If your out there please find me in Marathon. Were can we find you. Bring back this girl and the pier will be fine again. Sorry Soto you must go. Oh there are other performers we want back as well Tim H were are you.

Thought he retired

As I recall several years back Mr. Soto had a big retirement ceremony at Mallory Square that only a few privileged people could afford to go to. Now he wants everything his way - I wish I could have a big lavish retirment party then come back and continue where I left off!

Rotation is the way to go ...

This is not my area of expertise, but common sense tells me that rotating individual performers and groups (like all the art and food folks) on a daily manner into pre-defined divided "zones" would be the most fair way to solve this. No favortism and grandfathering rules work when it comes to making a living. Everybody wants to be in front of the water at one point or another because the crowds of tourists naturally migrate there. Provide a solution to give everyone a chance. A lottery also leaves folks thinking "is it fixed", etc. A rotating schedule, how hard is that?

What no one mentions in this whole article is that there are space constraints for the TIGHTROPE. It must be set up in a specific area. Will with the tightrope IS the face of Mallory Square and he cannot perform if he does not have a spot for the rope. Other people can set up anywhere. Will can't. Lousy reporting

oh stop already...

The most annoying part of the event is that you cannot stand/sit next to the water. Most of those spots are blocked by the performers. Stick all the performers in the courtyard area and let the tourists enjoy the sunset. Problem solved.
