Fatal crash suspect jailed

A 28-year-old Key West man with a DUI on his record has been charged in a three-car wreck that killed two people and injured three others, and could face his second DUI charge pending blood tests, according to state troopers.

Pierson Villalobos on Thursday was charged with two counts of vehicular manslaughter in a wreck two days after Thanksgiving that killed Marathon resident Christopher Jennings, 33, and his girlfriend, Deborah Mangrum, 42, who was moving here from Wyoming to be with him.

A Nicaraguan with permanent U.S. residency, Villalobos remains in Monroe County jail on $1 million bond, according to the prosecutor in the case.

"The concern is that given the serious nature of the offense, he might be a flight risk," Monroe County Assistant State Attorney Patrick McCullah said of the high bond.

Mangrum, who has four children and owned a hair salon in Lusk, Wyo., died at the scene. Jennings, who worked at Annette's Lobster & Steak House, died Dec. 3 at Ryder Trauma Center in Miami.

"Now we'll see if the legal system will provide justice," said Jennings' father, Michael. "He (Villalobos) has had a chance before and he obviously couldn't keep himself sober to drive a vehicle. He shouldn't be allowed to drive."

Villalobos has a prior DUI conviction from a May 2006 crash, when his blood-alcohol content was 0.2 or higher, according to court records. The legal limit is 0.08.

Florida Highway Patrol (FHP) troopers say alcohol also was a factor in the crash that occurred at Mile Marker 47 in Marathon about 9:25 p.m. Nov. 28, as Villalobos sped northbound, swerved into oncoming traffic and hit a southbound car that hit the car behind it, which Mangrum was driving, reports say. Villalobos' vehicle went airborne and flipped end over end before coming to rest.

Three other Marathon residents were hurt in the crash and taken to Fishermen's Hospital: Villalobos' passenger, Yendel N. Garcia, 32; Mercedes Diaz, 57, who was driving the car Villalobos hit, and her passenger, Jordi Torna, 10.

All have since been released from the hospital, FHP spokesman Alex Annunziato said.

the b.a.l. limit of 0.08 is a driver's license issuience law only. fact: you can still be found not guilty of D.u.i. if you have a blood alcohol level over 0.08 because of an induvidual's tolerence level to alcohol. remember, it is not illegal to drink then drive. it is only ilegal to drive under the influence. the legal definition of d.u.i. is: "having consumed alcohol to the point where a person can not operate a motor vehical in a safe mannor". what kills me is that why can't we just prosecute this guy regaurdless of whether alcohol was a factor or not? he was a bad driver ( a reckless driver). if alcohol turns out to be not a factor , will the charges be reduced?? jf

What does that even mean? .08 is a level, according to very widespread studies, that the judgment and reaction of the average adult is impaired. If alcohol was a factor in this crash, then it most certainly needs to be a factor in the prosecution, including his history of DUI.

fact: you can be found not guilty of d.u.i. (have the charges droped) with a bal of 0.08 and still lose your license for one year because the 0.08 law is a drivers license issuence law only! i had a bal of 0.16 and was found not guilty of d.u.i. because i was not driving in a wrckless or unsafe mannor and i looked completly sober on the vedeo tape. (i was pulled over for a burned out tail light). the 0.08 law is a stupid random level imposed on all of us by the revamped madd orginization. ( the founder of mad resigned in protest because the bal level was too low and resulted in a lot of innocent people to be charged with d.u.i.! she did not want people that had a few drinks to be charged with d.u.i. this is a fact.) every body has a different tolerence lvel to alcohol. why dont they just make it ilegal to drink then drive? jf

Apparently someone has spent some time looking at law books but not passing the bar exam. Go look up Florida State Statue 316.193 and tell us where it specifically states as you say,"having consumed alcohol to the point where a person can not operate a motor vehical in a safe mannor". DUI can be alcohol and or drugs but doesn't specifically have to be alcohol. With your mentality I am sure it's only a matter of time before we see you on the Sheriff's Arrest page for D.U.I.

i have been wrongly accused of d.u.i. 4 times! i have been found not guilty 4 times! and all with a bal over 0.08! at each trial my lawyer ,during jury selection, explained what constitutes a d.u.i.. the prosecutor nor the judge objected because it is true! it is not ilegal to drink then drive. only to "d.u.i." Well JF- I can tell you- I know I have never been arrested even once for DUI-neither have most of my friends or realtives- as a matter of fact- I only know personally 4 people with that tag. Only one with that tag TWICE -let alone 4 times. I watched a man in a 2 hour period take 4 shots of tequila- watched his impariment come and continue- he verbalized he was feeling strange and unable to perform simple tasks- he blew a 0.07! So if you blew a .16- IDGAS what your said lawyer got you off for-(Umm and O.J was "not guility as well- yeah- ok) you were-are and will continue to be a drunk until you do as the scumbag above has done and murder innocent people and only then will we be free of you while you rot in jail. TOTALLY FALSE. FACT: You can still be found guilty even if your BAL isn't at .08. You can still fail the field sobriety test if your BAL is below .08 and go to jail. Once you are at or past .08 it is automatically a DUI no matter how fat, skinny, male, female or just plain stuipd a person is.
