Acevedo awaits word on appeal

Deposed Monroe County Schools Superintendent Randy Acevedo is awaiting a panel of judges' decision on whether to grant him a new trial.

The 3rd District Court of Appeal in Miami on Thursday would not immediately release a brief Acevedo's attorney filed on June 3, which contained his legal arguments for seeking an appeal.

The State Attorney's Office must file an answer within 20 days, but can ask the appeals court for more time. Once that document is filed, a three-judge panel will consider the request and issue a written ruling.

Attorney Robert Herce argues there was not enough evidence to justify Acevedo's Aug. 28 conviction, among other things, but did not return The Citizen's phone calls Thursday to expound upon them.

Acevedo could not have been convicted of hiding his wife's crimes because she has not been convicted of any, his trial attorney, Catherine Vogel, wrote in initial appeal papers she filed. Monique Acevedo's trial is scheduled for Oct. 18, with a pretrial hearing at 1:30 p.m. July 29 in Key West.

Assistant State Attorney Mark Wilson, who prosecuted Randy Acevedo, disagreed, saying the jury in his trial essentially found that his wife had stolen money from the school district.

"The jury in Randy Acevedo's trial, in order to find him guilty of official misconduct, necessarily had to find that Mrs. Acevedo committed grand theft against the school district," Wilson said. "That was an element of the charge against him, which the state proved beyond a reasonable doubt."

The appeals court will either reject or grant Acevedo's request for a new trial, and in rare cases could reverse the conviction and order him "discharged," or free of obligations.

Monroe County circuit Judge Mark Jones sentenced Acevedo to three years' probation, a $15,000 fine and once-a-month community service.

Monique Acevedo, the former Adult Education coordinator, is accused of stealing almost a half-million dollars in cash-only cosmetology student and salon services fees, ninth-grade class fundraising money and in personal purchases made with her school district credit card.

Just like my post about the mosquito board, I am sick of the Acevedo crap as well. Enough is enough. I really do not care anymore. I think they both should be in prison or run out of town, but in Key West, white collar criminals are respected and even admired. Especially the ones who are born here. Lets move on and leave these people out of the paper. This is really not news anymore. If and when there is a final dispensation, let us know. In the meanwhile, how about reporting on something important, like why The Toppinos have still not explained how they built a concession stand without permits. Maybe he would have been a little more humble at yesterdays County meeting where he made fun of people who did not agree with him if the Toppino's dirty laundry was aired. Lets look at if their employees are legal, if the bids they are awarded were fair, and how they build things without permits. That would be news.

She delays her trial. They push his forward because of the right to a speedy trial. What a play. Now he gets to appeal because he is convicted of something that doesnt exist until they try his wife. The state attorney should hang if these two get off with these stunts. They are playing the system and none of you tax payers care. If any of the mason's believe in their code down here they would stop their support of Acevedo, (this includes you corrupt Rotarians as well)

I hope Randy wins the appeal and that the Judge completely reverses the court decision. This was a witch hunt designed to destroy Randy and levy guilt by association (marriage). On the other hand, if Monique actually committed what she is accused then she should face the full wrath of the court.

I 100 percent agree with the poster who called this a witch hunt. It has been one of the saddest stories ever. He has suffered mightily. It's not right what has been done to this man. One day people will see. But he won't be all haughty because that's not how he is. He is a good man. He just made a mistake.

Hi Morgan or Mikey. You must be the only ones left who believe this. Look, I understand the guy trying to protect his wife. I might have done the same thing. However, it was a crime, not a witch hunt, and he should be quiet and be glad he is not in prison. Swifty gave him a good job, he is still invited to Osterhoudters parties where he sees plenty of his old high school age students, and he even has some cash from those TV sales at Sears. what more can you want?

Acevedos may be crooks but they're not stupid. They know how to work the system. Why do you think Monique is still walking around and shopping? Neither one will ever see a day behind bars-- until we put the judges around here behind bars.
