Angler charged after pulling up diver

A biologist collecting data in 55 feet of water near the Western Dry Rocks last month was jerked to the surface by a fishermen apparently angry that her dive flag was in his fishing spot, according to law enforcement officials.

That fisherman, 74-year-old Donald A. Bamford of Stock Island, was arrested Wednesday on a misdemeanor battery charge after a monthlong investigation by state and federal law enforcement agencies.

Alison Johnson, a biologist with the Florida Fish and Wildlife Conservation Commission's Marine Research Institute, was collecting data on the mutton snapper spawn on the seafloor just south of the Western Dry Rocks on May 9 when Bamford grabbed her dive flag and used the line to drag her topside in less than a minute, said State Attorney's Office investigator Franklin Cohens.

Johnson told Bamford she needed to decompress, but witnesses said the fisherman began arguing with her about ruining his fishing spot, said Coast Guard Investigative Service Resident in Charge Paul Shultz.

Eventually, Johnson convinced Bamford to release the line so she could dive and decompress, but by that time she was suffering from a severe headache and made her way back to a FWC research boat, where fellow scientists treated her en route to shore, Cohens said.

Johnson was taken to Lower Keys Medical Center, where she was treated and released.

The Coast Guard told the FWC that Johnson was in state waters, which puts the case under the jurisdiction of the State Attorney's Office. FWC officers asked that the National Oceanic and Atmospheric Administration, which oversees the Florida Keys National Marine Sanctuary, become involved because the incident involved a FWC employee, said NOAA Fisheries Special Agent Kenneth Blackburn.

Johnson, who works out of the FWC's Marathon Marine Research Institute office, said she was not authorized to discuss the case.

Bamford, who is charged with misdemeanor battery, was released from the Monroe County Detention Center on Stock Island at 10 p.m. Wednesday after posting $2,000 bail, according to Sheriff's Office records.

Bamford has one other violation, according to Clerk of Court records. He was cited for careless operation of a vessel in April 2011 and paid a fine.

Anyone who tries to justify

Anyone who tries to justify this incident is simply as crazy as the creep who did this.

Not attached

For the record the diver did not have the line tied to herself. It was on a reel that she was still in the process of unwinding and had not locked it yet. The fisherman pulled hard on the line and it made the spool unravel, the sring hooked on her BC and she could not free herself in the 45 seconds it took to be pulled up. She has logged over 600 dives, is nitrox certified and a rescue diver.

Experience

All that experience and dive time yet she still couldn't get to her knife and cut the line.....45 seconds is a lifetime in an emergency situation.....Just a thought I had.

Not attached

As I heard it, she was not attached to her dive flag. It was a spool but it was unlocked since she and her buddy were still descending. When Bamford pulled it, the spool unwound and got hooked on her BC. Before she even knew what was happing, she was almost at the surface. We're talking about a time span of less than a minute.

This is no joke!

This woman is very lucky. She may have made dive mistakes but, the man should be charged with attempted murder. If he had really injured her, or worse, he would be in jail instead of bondinging out for pennies.

As a diver, I'm trying to imagine getting yanked to the surface from 55ft. This could have been very serious and this guy is lucky to only be getting a misdemeanor. What an idiot.

Never attach a surface support or dive flag directly to

yourself , also where was the support vessel that should have been following the flag ?

Catch of the Day

Good observation/advice Trapper. It's astounding that she did not or could not disconnect herself from the dive flag rope/apparatus as she was being reeled in as the CATCH OF THE DAY. One would think that the rig would have a breakaway/safety feature to prevent this from happening to her. Also, if she wanted to avoid being hauled to the surface like a jewfish you would think she would have had the ability to cut herself free using her dive knife (standard equipment when scuba diving). Hope Don entered his catch in the Key West Fishing Tournament. I believe they have an award for most unique catch of the season.

BS. Who dives expecting something like this? I can't believe that someone there didn't make chum out of that bozo.

Exactly, who would expect this scenario ?

but , as a diver you are taught to expect the unexpected, and a vessel running over the line to the flag is a very real expectation , being towed like a water skier could have serious consequenses. Just like not attaching a stringer of fish to yourself while spearing, the ability to let it go quickly can make a big difference in your day. I'm not placing blame on the diver but I have found most researchers and biologists sometimes have the minimum training standards, perhaps upgrading the level to at least "advanced" level could help. Unfortunately no amount of training will prevent others from being an A**h*le and directly interferring with your day.

How about "training" the idiot, greedy fisherman not to pull a stunt that could kill someone just so he can rape the resource. A couple of years in an institution of higher "learning" should do the trick.
