Peary Court on agenda tonight

The Key West City Commission is expected to decide tonight whether to approve a special zoning designation for the Peary Court housing development, allowing a density of nine housing units per acre, paving the way towards consideration of a full-scale development plan being prepared by investors.

Spot Zoning

"Contract zoning occurs when a local zoning authority accommodates a private interest by rezoning a district or a parcel of land within that district. Then the private interest may then be allowed to develop the land where before the zoning regulations prohibited such a land use. This is spot zoning in all instances."

Spot zoning is illegal in most instances.
