Appeals court overturns Galleon ruling, agreeing family was robbed of land use

A state appeals court has overturned a Florida Keys judge's ruling in a decades-old, high-profile No Name Key property takings lawsuit.

And, the ruling could cost the Monroe County government and its taxpayers between $3.5 to $5 million.

Judge was way off base

The Third Circuit ruling was most critical of Judge Audlin. He misconstrued the law, he does not know the meaning of "and," he disqualified one expert, and allowed the county's expert to testify that storing lobster and crab traps was the highest and bet use of the land. If one did not know better, one might think the judge twisted the law and the language intentionally to get to his desired outcome.

Why do I imagine Sal is somewhere doing the Happy Dance over this ruling. The reality is in this case he was always right.

End Discrimination on No Name

The time has come to stop siding with one vocal woman's desires and treat an entire community fairly. Enough is enough. Her manipulation of the County and taxpayers over the land next to her home, Galleon Bay, her playing a direct role in such a stupid local Ordinance that prohibits power, sewer and such, the money this has cost taxpayers and the pain it has caused her community is a sad, sad, shame. And now we learn that her selfish desires have put a hault to sewering homes along State Road 905 in Key Largo, stopping them from protecting our environment just as she's been doing on No Name for decades. Stop the hypocracy! No Name has 43 homes, most running on diesel generators and all using antique battery operated solar systems, many of those using golf cart batteries. The island is home to not one but two rock pits where blasting and dredging have stolen tons of earth from the island over the years. The EPA long ago found waste water pollution in the islands canals. And yet that one woman and her ever so few 'supporters' cry that they are trying to protect the place? Yeah, right. I say protect this remarkable place for the long term by allowing those exisiting homes to tie to their new power poles and net meter them so as to truly show others the future of solar power. The children today and in the future deserve real leadership right now over this topic so as to see how a community can leverage the sun in an intelligent way. I say sewer those exisiting homes to stop the pollution and then go about cleaning the waters up, the fish deserve better. I say stop the rock pits and commence a plan to rebuild the damage woefully short sighted people of the past caused by allowing such devastation. The animals deserve better. I say end the Discrimination once and for all so people can protect No Name in a lasting way and go about their lives in peace. The existing residents, surely the majority there, deserve nothing less. In fact, an apology over the damage done to their lives by our local government allowing a terrorist to cause such pain would be a nice start right after this lousy law is repealed.

Could Cost the County? Is this a Joke?

That is a question to who? Who read the case? I did. The county LOST. The appeals court not only remanded it to the trial court, but did so with an ORDER saying the county is LIABLE for the damages. The ONLY thing to be determined by Monroe County Circuit Court and a jury is the AMOUNT of damages the county will have to pay. Again, our clueless politicians make stupid decisions (supported by incompetent judges like Audlin) costing the taxpayers millions of dollars in this takings lawsuit. What the case doesn't seem to answer (hopefully an attorney might know) is if Galleon gets to develop that subdivision on No Name or what happens to the land AFTER the county pays millions of dollars in damages. It sounds like they get damages and get to go ahead with development and the county can go screw itself as can the people against power on No Name. The County read the handwriting on the wall and they need to send all the lawyers packing and stop wasting the taxpayers money for the agendas of individual big mouths. There are various other takings lawsuits at various stages the county is going to have to settle or have their asses handed to them in the appeals court and then settle for even more money. County Board: Morons.
