City's message to Congress: Ban assault-style weapons

The City Commission appears ready to unanimously approve a resolution Wednesday urging Congress to ban "assault-style weapons and high-capacity magazines," and require mandatory background checks and training with every firearm purchase.

Key West is weighing in on the turbulent national debate over curbing gun violence just days after President Barack Obama announced a sweeping proposal for new controls.

In addition to the shock of the Newtown, Conn., schoolhouse massacre of first-graders on Dec. 14, on top of the July 20 Colorado cinema rampage in which 12 people were killed and dozens injured, Obama's hometown of Chicago clocked more than 500 homicides in 2012.

Sponsored by Commissioners Teri Johnston, Clayton Lopez, Billy Wardlow and Jimmy Weekley, the resolution also has the support of the rest of the panel, interviews on Thursday confirmed.

A 7-0 vote in favor of sending the resolution to the Florida Keys' congressional delegation is expected at the commission's 6 p.m. Wednesday meeting at Old City Hall.

Crafted as a response to the unspeakable violence that tore apart the community of Newtown last month, when a troubled young man executed 20 first-graders and six adults at an elementary school before shooting himself, the resolution was first proposed by Police Chief Donie Lee days after the massacre.

"When the Second Amendment to the U.S. Constitution was drafted, granting most citizens the right to bear arms, legislators could not anticipate the destructive power of modern assault weapons," the resolution says.

The Newtown massacre "highlights the far-reaching consequences when assault weapons fall into the hands of an individual whose clear intent is not protection or defense, but murder," the statement continues.

In contrast to Lee, who is a hired police chief, the newly elected Monroe County sheriff said Thursday that he wouldn't join the gun control debate.

"Whatever laws come out, we're going to support," said Sheriff Rick Ramsay. "My job is to enforce laws. We're not policymakers. I do believe in an individual's right to own and bear arms, and also reasonable gun regulations."

Although the decision-making on gun control will be made in D.C., Mayor Craig Cates said he felt compelled to vote in favor of the island's proposed resolution to bar assault weapons.

"I'm going to vote for it, but I want to explain that I don't agree with all of it," Cates said by phone Wednesday from Washington, D.C., where he was attending the annual U.S. Conference of Mayors.

"I'm not going to not vote for it. It's too important an issue. Once it gets to Washington, D.C., a decision has to be made." Commissioners Mark Rossi and Tony Yaniz said Thursday that they, too, would vote in favor of sending lawmakers the message for stepped-up gun regulations.

"Yeah, we've got to pay attention," said Rossi. "This is something that is an everyday, real problem. I don't think we need to have people with M-14s and AK-47s."

Yaniz, who owns a couple of handguns himself, said he doesn't want an assault rifle ban to "whitewash" what he considers the heart of the matter behind Newtown and other violent attacks -- the nation's neglect of mental health care.

"I'm a left-wing liberal and I believe in the Constitution," said Yaniz, who was also in D.C., for a series of meetings with Keys representatives in Congress. "But I agree the intent has been so bastardized right now about assault weapons. But is this going to stop because we ban clips and assault weapons? I don't think so. We need to look at the root cause."

Also on Tuesday's agenda is a related resolution directing City Manager Bob Vitas to work with Monroe County Schools Superintendent Mark Porter and local police agencies "to develop a plan and funding strategies to safeguard the city's schoolchildren."

The School District pays law enforcement agencies to provide security at the public schools. "School resource officers" are assigned to all middle and high schools.

Cates said he supported banning high-capacity magazines that make rapid, lengthy gunfire an easy reality; he also supports "universal background checks."

But he wasn't convinced that banning assault-style weapons from law-abiding citizens who responsibly handle their firearms would prevent another school-shooting massacre of the Newton, Conn., type.

"There are a lot of people who own assault weapons," said Cates, after hearing Vice President Joe Biden deliver a 45-minute speech about increased gun control in the wake of the unspeakable Newtown disaster. "What do they do, throw them away?"

Biden made good points, said Cates, but there remain so many unanswered questions about gun control.

"We're very supportive, but making some guns outlawed that people use for sport and all is maybe more than we should do," Cates said. "We don't have all the details. It's way above our level, the decision. I'm definitely in favor of increasing gun control and background checks."

Read and try to understand the 2nd amendment

For the fools in Government in Key West and other places around the Country, The type, destructive power and amount of destructive power has nothing to do with the 2nd amendment. The 2nd amendment has everything to do with equality. Equal power for the people to go to war with the crooked polititions that would take those rights. How amazingly stupid does a Police Chief have to be to make a statement "granting most citizens the right to bear arms, legislators could not anticipate the destructive power of modern assault weapons". For the love of GOD, please tell me what that lame brain meant by that? It is so incredibly, blatantly evident, that the founders followed the first amendment with the second in order that we may enforce our rights. The 2nd is the only amendment that wasn't debated. Much to the contrary of Chief Lee’s statement, the founders were concerned with limiting the power of Government by providing the Citizen with rights that would limit that power. If the Government had .38 caliber pistols, the Citizen would have .38 caliber pistols. It mattered not the destruction power, what mattered is that the Government could not outgun the Citizen. So if you’re planning on limiting the Citizens firepower Chief, I would start with eliminating the overwhelming and destructive power of the Key West Police Department first, not the Key West Citizen. Foolish actions betray City Commissions underlying intentions.

As if the Constitution and Bill of Rights didn't exist. Do government representatives and employees across this Nation, think they have the authority or the mandate to call for a violation of our rights? Do the City Commissioners in Key West realize they do not represent the citizens of Key West when they act unilaterally to call for restrictions on their residence, in violation to the US and Florida Constitution? This is an blatant usurpation of the rights of the people that elected them. Here We Go

Every politician in the world wants to get on the "sweeping" changes band wagon. But if they actually read these dramatic proposals they will see that they don't amount to spit. Lip service and little else all the way from the president to the police chief of a tiny island.

THE REAL PURPOSE OF THE 2ND AMENDMENT

What the Founders had in mind is quite clear and there is no doubt about what they were thinking. George Washington stated that "Firearms stand next in importance to the Constitution itself. They are the American people’s teeth and keystone under independence." Jefferson had similar thoughts stating: "And what country can preserve its liberties, if its rulers are not warned from time to time, that this people preserve the spirit of resistance? Let them take arms . . ." Hamilton said: "If the representatives of the people betray their constituents, there is no recourse left but in the exertion of the original right of self-defense which is paramount to all forms of positive government." As Benjamin Franklin said long ago, "They that give up essential liberty to obtain a little temporary safety deserve neither liberty or safety." Don’t be fooled by those who pretend to want to decrease crime by firearms regulation. Their real aim is to disarm us, with the intent of promoting their agenda of a socialist dictatorship and making sure there is no effective opposition. There will ALWAYS be bad people among us, so why do the few bad people in society seem to pave the way for the dismantling of all of our Liberties? What will you do when our benevolent gov't succeeds in stripping away all the guns from law abiding citizens, and therefore, the only ones left bearing arms will be the criminals and the gov't? Think about it.

It is a proven fact that anywhere in America we practice strict gun control there is MORE violence and gun crimes! The first gun regulations only lead to more! Soon guns will be OUTLAWED if we allow this or any administration to restrict our gun rights, we will eventually lose them for good! The second amendment PROTECTS our FREEDOM!!

It's a shame that the children of Newtown are being used to push for tighter gun laws. It's a bigger shame when our local government officials are feeding into it also. As an American my right to "keep and bear arms, shall not be infringed" even if that means joining/creating a "well regulated militia" to protect myself from my own government. Thank God for the 10th Amendment. If it was'nt for the 13th Amendment we would even have a black president, lets attack that Amendment and see where we wind up.

Why would any sane, intelligent person want an assault weapon?

There seems to be zero common sense in interpretation of the Second Amendment, put into effect when there were muskets and local militias. There is no 'sport' in using assault weapons in any manner whatsoever. Ban them and the high capacity magazines.

One can barely get to the grocery store without the fear of as joe biden puts it: :"Being riddled with bullets." Drugs are illegal but anyone can buy them. Why keep law abiding citizens from owning these weapons when the criminal element will go underground and buy them. This places law abiding citizens at a disadvantage. Do the city commissioners and mayor have nothing better to focus on?

First, the City should worry about its own business. Second, it's not for them to tell us what we can and cannot own especially if it's protected by the Constitution. Third, I think Rossi meant an M-16 instead of an M-14. The M-16 is not readily available to civilian populations. Perhaps he was referring to the civilian make which is an AR-15. Either way, Rossi should shut up if he doesn't know what the hell he is talking about. Stick to strip clubs and cruise ship tourists. It's not legal gun owners who are the problem. It's the nuts who have been taught by society to take out their frustrations through violence because they were not taught coping skills by their parents. Let's lay the blame where it really lies. Oh and there are already stringent background checks for weapons. You can only buy through an FFL dealer who conducts an FBI background check before you are ever allowed to leave with one. Even if you buy online, it still has to go through an FFL dealer. They cannot and will not just mail a weapon to you.
