Power ruling: State must decide

A state appeals court ruled the Public Service Commission (PSC), not a Monroe County court, should decide whether commercial power can be brought to No Name Key.

"The Florida Public Service Commission has exclusive jurisdiction to decide the issues raised by the appellants," the 3rd District Court of Appeal ruled in an opinion released Wednesday.

How did that part time

How did that part time American gain this much influence? If I had known how easy it was I could have ruled the world.

The planning commision is composed of nothing but nuts and are

extentions of the nuts that choose them(BOCC)and now that Ron Miller's on it the fruit cake is complete. Cameron was the last planning commisoner with any common sense.

County Attorneys are idiots

Bob Schillinger and Derek Howard are idiots! They want to take this fight to the PSC, and when the PSC tells the county to issue the permits they will appeal to the Florida Supreme Court--but only if the County Commission lets them. Let's hope that George, David and Danny have the courage to stand up to these idiots and bring and end to this madness. If the attorneys cause more delay at taxpayers expense, the tab is likely to be very much larger, as they are interfering with peoples' civil rights. Damn, it took more than 2 years for the appeals court to uphold the dismissal of the first county complaint.

Putney's Strategy Is To Delay All of This No Matter The Cost

She now knows she can't win, has for some time, but will do what she can to delay, delay, delay. Two years ago the former County Atty told the BOCC that the power company was allowed to install and rather than heed her legal view they supported Ms. Putney and have done all to possible to add to the delay, costing taxpayers a bundle while doing her dirty work (again). Why not do what the community cleary has long wanted and stop following a liar?

I see all these comments and don't really have a dog in this hunt, but I keep reminding myself that these people knew it was off the grid when they bought their houses! How have they suffered or been abused, when they knew the land rules and situation full well when they bought? I doubt the comments would be so kind if this were Old Town residents suing The City to enforce noise laws on Duval, or people crying about Jet noise near the airport. The comments would be "you knew what you were getting when you moved in, if you don't like it move!" How is this any different?

Ah yes, the 'you should have known better' excuse....

How about the Eakens? They are there 40 +/- years and nothing prevented them from power. In fact, they actively sought it but the utility (which has caused as much harm, perhaps more, than the County)wanted a few more more homes (money paying customers) than the 4, 6 or 8 that existed back then. No law prevented them from power nor does any of the 43 home's deeds. It's a fantasy. A farce perpetuated by one LOUD resident who convinced the County she spoke for the community (she did not) and that no one wanted power. She wrote a law saying such while a planning commissioner (and while the lead person in a lawsuit fighting people who wanted it GIVEN to them). The County then went about enacting a local Ordinance prohibiting any number of things (power, sewer, phones) but never told (or asked) the residents. The County never properly advertised it. Never held a public meeting for the community. Never wrote to them to notice each home. Zip. It has since allowed phone service. So the next time you are walking your 'dog' think of how you would feel to have your neighbor, the County, and others steal such a simple right as to pay (which the current group did, in full) for power.

That "Ding Dong" Sound You Hear Is

the beginning of the end of that Wicked ("Obviously Disapointed") Witch from No Name Key. The Eaken family has sought power for 40 years and during that time has had the County, the power company and their witch of a 'neighbor' do everything possible to hurt them (including use her quasi public 'service' role as a Planning Commissioner to mis-lead the County much less hurt nearly 'her' entire community) and ultimately steal from them. It is FAR past time for the County and utility to end the suffering it has caused those poor people as well as to stop wasting tax payer money on this farce of a fight for one truly wicked woman. Issue them permits, place them back into the central sewer plan, clean their polluted canals, allow potable water and then leave them alone to live in peace. They deserve nothing less than fair and equal treatment to any other property owner in the County...so said the Appeal's Court and soon too will the Public Service Commission.

About Time

The County Commissioners, past and present, that keep saying "Let the Courts Decide" have really been saying "There is a bottomless pit of Taxpayer money to pay Attorneys to shuffle paper in this losing battle"

Quit screwing around with this and let those who want to hook up.

Wasting Taxpayer Funds

The BOCC needs to change. Wasting our taxes attempting to steal private property rigts, defending bogus laws, preventing businesses from creating jobs and industry. We are being led by the " I have miners" special interest. Enough is enough. Fiduciary irresponsibility. We need to elect some intelligence to lead us or there will be pitchforks in the street.

Intelligence is not necessary.

Common sense is what those 5 fools(BOCC)lack.

They need to add this to the "Comp Plan"

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness..And Power!!!!!!!!!!

Stop wasting our tax dollars

The County has been growling over this bone far too many years at a waste of our tax dollars.

I think Putney's done....

All the commissioners on FSC live north of the Last Chance Saloon and far from LaLa land. I think the Reynolds will be hooked up to 120volt AC by summer.... They’ve earned it..

No Surprise

Plain and simple, these people have been discriminated against and the waste of our money over all of this should end too. I know one family that's out there since the 1970's talking about asking for power. How can the County treat them like that for so long and nobody put a stop to it? Good for the one or two families that have put their money where their mouth is and now find out that even the Court agreed with them.
