Second power lawsuit sent to PSC
Judge: Public Service Commission should decide on electricity for No Name Key

A Monroe County judge has dismissed a second lawsuit about bringing commercial power to No Name Key, ruling again that the case should be heard by the state Public Service Commission (PSC), not the local courts.

Circuit Court Judge David Audlin, who ruled Thursday, is open to ruling later on some issues in the case if the PSC does not rule on them.

The Cost & Smell of Discrimination

Read the Court filings they have made over the last year and it's clear that the PSC will (of course) say power IS legal on No Name. Funny thing (sad too) is that Keys Energy's staff attorney told his Board for yeas that they are not regulated by the PSC. The PSC will soon formally rule on what two Courts have already proved. Power is legal and some loud mouth local can't stop that when challanged in the light of day. Only after the PSC Complaint took place did the power company Board take a second vote and then installed and powered the lines. Gotta ask why it took them 40+ years to do the right thing or why they would have partnered with the County to hurt residents that sought power for so long. I hope the County is forced to pay MILLIONS for what they did to those people, the pain and suffering to their lives much less to be forced to come out of pocket for the cost to sue the County and seek fair treatment through the Courts is shameful. Based on the way they have treated the No Namers, this has not been Monroe County's finest day (err four decades). Once this power thing is resolved I hope the Citizen will explain why No Name is not in the central sewer plan. That sure smells (pun intended) like more of the same old same old discrimination.

They call these kinds of suits

Frivolous, a county standard.
