Teen rape alleged
Boy, 14, accused of assaulting drunk girl

A 14-year-old boy was charged with felony sexual battery after allegedly having sex with an intoxicated 14-year-old girl in a Smathers Beach bathroom the afternoon of March 9, according to Key West police records.

Rick Hayward Fisher was charged the same day with first-degree felony sexual battery with a victim over 12 years of age, according to a juvenile arrest affidavit....

So, as far as anyone posting here knows, a local boy of some quasi- celebrity family was accused of rape. On one side it seems there is a very vocal group calling for this boy's head and/or testicles. On the other side there are the ones who will not jump to conclusions, and will wait for our LAW of the LAND to play out. There are some of us who refuse to convict anyone by the Press. Flame me if you want, but I prefer to stand by Our guarantee (as Americans) of 'Innocent until PROVEN guilty'. And the proof 'aint in the press. From what I can see from these comments, the ones who would let the legal system play out first are saying 'If he did it, punish him!' And those who already know everything... From a Citizens article... have already convicted the kid, and are serving as Judge, Jury and Executioner. Just so you know, I'm of the opinion of if he did it, then no penalty is too severe for a crime of this nature.

Its clear some of the readers do not know what alleged means. How is this case going to be tried fair now in this county. Its not. The truth will come out in court hopefully and let the justice system do its job. As far as the comments about him being a spoiled brat, from where I am sitting most kids now days are not only spoiled but disrespectful, ungrateful, and arrogant just like their parents taught them to be.

Whether it is the alleged victim, or the alleged perpetrator, justice will be given to them in court. I do hope that the system gets this right. When was the last incident with a juvenile commiting a felony, and having their name revealed in the media? Whether the Fisher boy is innocent or guilty I protest him being tried by yellow journalism. If he is guilty, I hope the young lady, with proper help, can move on and follow her dreams.

I totally agree with what you said. You seem not to be apathetic to the accused. You said '' If he is guilty, I hope the young lady" What if he is not guilty, he will always have the stigma about being a predator.Does anyone know if the girl and her family pressed charges or did the police and prosecutor did? The public has no idea that if a teenage couple gets drunk and have sex, the boy can be arrested and not the girl. This is sexism against boys. They both can engage in reckless behavior but because of the way the laws were written ( guided by feminist that hate it when boys have sex with girls)the boy is the only one charged?The families can be cool with it but law enforcement still commits with the charge. I am not sure if this is the case with the Fisher boy but it happens all of the time. There are financial incentives paid to law enforcement , prosecutors, judges, and courts to charge men and boys with sex crimes. Sex crimes are the only crime where there does not have to be any proof, evidence or witnesses for the police to arrest. I am not angry nor have I ever been arrested.There is something wrong when two teenagers have drunken or drugged sex and police are directed only to arrest the boy. I do not know if is the case here but from what I read and heard it is.What did I say that was untrue or hateful? Are you familiar with protective orders and restraining orders? Any women can go see a judge in a secret meeting and get one against her domestic male partner. She does not have to give any proof of abuse or threats, the judge just gives her the protective or restraining order.She gives the order to law enforcement . Her male partner is met at the end of the driveway upon returning from work by the cop. He is told that he can not enter the house or he will be arrested or shot. He will not be allowed to pick up his property, see his pets and see his children for months. He will get a hearing in court but the judges never rescind the order.So how is that by me exposing all of these sexist laws and policies against boys and men make me mad and angry?This is wrong what they are doing. Did you know domestic violence is created equally by both genders.? The laws are only against men and boys . I worked with the Fisher family for over nine years. They do not think themselves above the law, just the otherwise. They do not think themselves as royalty- far from it. I too knew Mel, jovial man, ok tipper, but fun and pleasant to serve, every day at 2 Friends Patio, double Bacardi and cokes with lime, I also know Kim... the two are very different men. The Fisher name is a local in the news all the time name, and that is why they mentioned it. If it were an Obama relative I am sure you'd expect Barack's name to be mentioned. The family are local celebrities, and wealthy ones, of course their family members involved in anything will make the papers. I never attacked the alleged victim. I am attacking the justice system that is heavily biased against men and boys. I cited my sources, cases and laws.I gave a synopsis of VAWA and other misandric laws and policies. Why do you have to attack me personally and not refute what I state with counter information. There has been an epidemic of false allegations against men and boys since the passage of The Violence Against Womens Act.The prosecutors office gets paid VAWA money even if there is no evidence of a sexual assault or if the sex was consensual . What drugs are you on? The epidemic is global, and it is RAPE and other horrendous acts of violence against women and children. There is nothing in the VAWA bill for financial gains to any law enforement officers or officials. The federal government tells the states how the money is to be spent. It is all on line. Florida has the highest paid administrator of the domestic violence industry in the country. She is paid $200,000.00 a year. Domestic violence is a multi billion dollar industry. Ok , how is the VAWA money distributed among the government class and law enforcement? Is a great place to raise kids. A very small percentage of the kids in this town are troublemakers and most of those will grow out of it. Same as it is in Anytown, USA. The rest are a joy to watch as they figure out life with the help of their parents, teachers, and friends. I didn't grow up here, and I saw the same problems with kids when I was one 50 years ago in a different City. As for mimicking stupid adult behavior, between TV and the Internet there isn't a kid in America that doesn't see adults acting stupid.

Key West is a good place to raise children and your family. I grew up in Boca. In Key West everyone is helpful and friendly. People here pull over and help that little old lady trying to change a flat tire. In Boca Raton people would pass by and laugh'' I am glad it is not me"I don't miss that place and I am glad I am here. Do you think that store owner who's store you have been patronizing for 30 years in Boca would know your name? They will in Key West usually.

This incident is a tragedy. It's a tragedy to the young woman involved. It's a tragedy to the young man. It's a tragedy to the society that produced young people than think that underage drunkenness is okay, that such utter disrespect for other individuals is okay. It's all beyond horrible. But, is it news? The only newsworthy item in this entire smear is that the young man involved is a Fisher. If the young man was from a less noteworthy family, this either never would have made the paper, or it would have been published without the name. The Fisher family has been a source of pride in this community for many many years, and to publish the name of one family member for a possibly criminal act when underage is shockingly irresponsible. This sort of garbage puts this paper in the same league as the National Enquirer. I am shocked and sickened by all of this.....and I am neither a Fisher nor a youthful offender....just a citizen that thinks that ALL kids deserve a second chance and to have their youthful stupidity sealed at adulthood. You suck!!

It is September 11th, it is an Earthquake in Haitti, it is a Hurricane in New Jersey or here even for some, it is a burning childrens home with children inside. This paper is so unbelievably stupid to post this. I love the Editor's note: " It is The Citizen’s policy to name juveniles when they are accused of violent felonies." Did anyone check to see if it was the state of Florida's law to publish a minor's name who has been convicted of nothing? The writing in this article is basically ruining the life of a 14 year old boy. Not to mention, this article has some of the most ridiculous evidence I have ever heard. Her friend supposedly walked into and out of the bathroom several times and tried to help her? Really? And noticed a violent crime being committed and did nothing. Sounds violent! Sweet friend. This sounds like a bunch of drunk kids who made really bad decisions, and everyone wants to put the blame on a cocky boy. If this girl was truly raped then this is absolutely awful. The boy should certainly be tried and face the consequences. However the fact that The Citizen would publish this article about a kid who even if found innocent will never find a job or have a life if anyone looks his name up on the Internet, is appalling. You have no morals whatsoever. Why on earth would you use his name? You don't even know if these very "credible" witnesses were also 3 times over the legal limit like the victim. Would it also make sense that a 14 year old boy who was drunk might not be a great judge of how drunk someone else was? I hope for the sake of the KWPD that their evidence/report doesn't match that of the "tip" supposedly leaked to the newspaper. I think the Citizen jumped the gun on this and I hope for the sake of everyone involved, the too will have to pay the price.

She is excused from responsibility for engaging in reckless behavior ?She was drunk too.The reason why she was not charged is because under The Violence Against Womens Act the prosecution receives VAWA money even if they loose the case.The court,judge, cops all get VAWA money.
