ISLAMORADA -- The village went to trial Monday, Feb. 10, with Bob Brown, architect of the Capital Bank Amphitheater at Founders Park, after mediation last week failed to yield a deal.

"There was no settlement. We're going to court," Mayor Ted Blackburn said of the Feb. 3 mediation session.

The village halted construction of the amphitheater in 2004. Two years later, Island Community Entertainment finished the project. But litigation between the village and Brown has been ongoing since 2006.

The village paid the builder Intercoastal Contracting $135,000 in October as settlement in the suit but did not reach terms with Brown.

The trial was scheduled to last through Wednesday, Feb. 12, at the Plantation Key courthouse.
